LivenLabels Livestreaming Terms of Service

Welcome to LivenLabels, a platform for livestreaming and sharing creative content in categories like animation, art, design, development, photography, and more. These Terms of Service ("Terms") govern your use of our website https://livenlabels.com/ and mobile application (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

 

1. Definitions

  • Company: LivenLabels, based in Japan, referred to as "We," "Us," or "Our."
  • Service: The LivenLabels website and mobile app, enabling livestreaming and creative content sharing.
  • User: You, the individual or entity using the Service.
  • User Content: Any content (e.g., livestreams, videos, text, images) you broadcast, upload, or submit to the Service.
  • Device: Any device (e.g., computer, smartphone, tablet) used to access the Service.

 

2. Acceptance of Terms

By using the Service, you agree to these Terms and our Privacy Policy, which explains how we collect, use, and protect your personal information. You must be at least 18 years old to use the Service. If you represent an organization, you confirm you have the authority to bind it to these Terms.

 

3. Using the Service

3.1 Eligibility

To use the Service, you must:

  • Be at least 18 years old.
  • Provide accurate and complete information when registering or streaming.
  • Comply with all applicable local, state, national, and international laws.

3.2 User Accounts

  • You may need an account to livestream or access certain features. You are responsible for keeping your account credentials secure and for all activities under your account.

  • We may suspend or terminate accounts for fraudulent, abusive, or unlawful activity.

3.3 User Content

  • You retain ownership of your User Content. By broadcasting or uploading content, you grant LivenLabels a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, and display it to operate and promote the Service.
  • Your content must comply with our Community Guidelines, which promote a safe and creative environment. Content that is sexually explicit, obscene, or otherwise inappropriate for our diverse, global audience is not permitted.
  • We may remove or modify content that violates these Terms, our Community Guidelines, or is deemed unsuitable at our discretion.

3.4 Prohibited Conduct

You agree not to:

  • Stream or post content that is illegal, harmful, offensive, or violates third-party rights (e.g., copyright, trademark, privacy).
  • Use the Service to share content that is sexually explicit or inappropriate for a general audience.
  • Interfere with the Service’s functionality, security, or other users’ experiences.

 

4. Third-Party Links and Services

The Service may include links to third-party websites or services (e.g., social media platforms integrated with livestreams). We are not responsible for their content, policies, or practices. Use these services at your own risk and review their terms and privacy policies.

 

5. Termination

We may suspend or terminate your access to the Service without notice for reasons including:

  • Violation of these Terms or our Community Guidelines.
  • Illegal, harmful, or inappropriate activity, including streaming content that does not align with our values of creativity and inclusivity.
  • At our discretion, with or without cause.

6. Limitation of Liability

To the fullest extent permitted by law:

  • LivenLabels and its affiliates, licensors, and service providers are not liable for indirect, incidental, special, or consequential damages (e.g., loss of profits, data, or opportunities) arising from your use of the Service.
  • Our total liability is limited to the amount you paid for the Service, or $100 USD if you paid nothing.
  • Some jurisdictions may not allow certain limitations, so these may not apply fully to you.

 

7. "AS IS" Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE," without warranties, including:

  • Merchantability, fitness for a particular purpose, or non-infringement.
  • Uninterrupted, error-free, or secure operation.
  • Accuracy or reliability of content, including livestreams.

Some jurisdictions do not allow warranty exclusions, so some limitations may not apply to you.

 

8. Governing Law

These Terms are governed by the laws of Japan, excluding conflict of law rules. Your use of the Service may also be subject to other local, state, national, or international laws.

 

9. Dispute Resolution

9.1 Informal Resolution

9.2 Arbitration

Unresolved disputes will be settled by binding arbitration in Japan under the rules of the Japan Commercial Arbitration Association (JCAA). Either party may seek injunctive relief in court for intellectual property or confidentiality issues.

 

10. Special Provisions for EU and U.S. Users

  • EU Users: If you are an EU resident, you have rights under GDPR and local consumer protection laws. These Terms do not limit those rights.
  • U.S. Users: You confirm you are not in a U.S.-embargoed country or on a U.S. government restricted list. California residents have rights under the CCPA (see our Privacy Policy).

 

11. Severability and Waiver

  • Severability: If any provision is unenforceable, it will be modified to reflect its intent, and other provisions remain in effect.
  • Waiver: Failure to enforce a right does not waive it for future enforcement.

 

12. Changes to Terms

We may update these Terms at our discretion. For material changes, we will provide 30 days’ notice via email or on the Service. Continued use after changes take effect means you accept the updated Terms. If you disagree, stop using the Service.
